These Terms & Conditions ("Terms") are a legally binding agreement between you ("Subscriber", "you", "your" — the parent/guardian registering a student) and E-Vidya Academy, a sole proprietorship of Kumudini Rout. By registering on this website, obtaining a roll number, entering a classroom, or making any payment, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, Disclaimer, and Refund & Cancellation Policy below, each of which is incorporated into these Terms by reference.

1. Eligibility

  1. You must be at least 18 years of age and the parent or lawful guardian of the student for whom you are registering, with authority to consent on that student's behalf, to use the Service.
  2. Information you provide at registration (name, class, phone number) must be accurate and kept up to date. Providing false information, or registering on behalf of a student without the necessary parental/guardian authority, is a breach of these Terms.

2. The Service

  1. The Service consists of AI-assisted supplementary digital learning content — audio, video, notes, mind-maps, chat-based revision, and self-assessment questions with an auto-generated marksheet/certificate — accessible after registration and obtaining a roll number.
  2. The Service is a supplementary learning aid only. It does not replace the student's prescribed textbook, regular school attendance, or classroom teaching, and we make no representation that it is a complete substitute for either.
  3. We may modify, add to, remove, or discontinue any part of the Service, including specific classes, subjects, or features, at our discretion.

3. Registration, Roll Numbers & Account Security

  1. On first use, you will register the student's name and mobile number to receive a roll number. This roll number, together with your registered mobile number, is your means of accessing the classroom and must be kept confidential.
  2. You are responsible for all activity that occurs using your roll number. Notify us promptly if you suspect unauthorised use.

4. Fees, Free Trial & Payment

  1. New Subscribers receive a free trial of 3 days per student. The trial requires only registration; no payment details, card, or commitment of any kind are collected or required during the trial, and you are free to decide at the end of the trial whether to continue.
  2. If you choose to continue after the trial, a fee of ₹250 (Rupees Two Hundred Fifty only) is payable via UPI for one calendar month of access to all subjects for the relevant class. There is no automatic renewal; you decide separately, each month, whether to pay for the next month.
  3. Full details of the trial, payment, and refund mechanics are set out in Section 5 (Refund & Cancellation Policy) below, which you should read before making any payment.

5. Refund & Cancellation Policy

  1. Free Trial: New Subscribers receive a completely free trial of 3 days per student. No card, payment details, or commitment of any kind is required to access the trial; you may freely decide at the end of the trial whether to continue.
  2. No Obligation to Continue: If you do not pay after the trial, your access simply ends. No charge is ever made without your affirmative payment.
  3. Monthly Fee: Continued access after the trial requires payment of ₹250 via UPI for one calendar month of access to all subjects for the relevant class. This is a one-time payment for that month only; there is no automatic renewal, and you decide afresh each month whether to pay again.
  4. Non-Refundable: Once a month's fee is paid, it is non-refundable. In exchange for that payment, we commit to making that month's classes available to you for the full month.
  5. Service-Failure Exception: If we fail to deliver the Service for a material part of a paid month due to a fault on our side (for example, an extended platform outage), we will consider a pro-rata credit toward the following month, or a refund, at our discretion, upon a verified written complaint made within 7 days of the fault.
  6. Suspension for Breach: If your access is suspended or terminated for breach of these Terms, fees already paid for the current month are not refunded, unless the finding of breach is later found to be unjustified.

6. Licence to Use; Restrictions

  1. Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for the personal, non-commercial educational benefit of the registered student only.
  2. You shall not, and shall not permit any third party to: (a) copy, record, download, screen-record, redistribute, publicly perform, sell, rent, or sublicense any part of the Service or its content; (b) reverse-engineer, scrape, or use automated means to access the Service; (c) share your roll number or login credentials with persons outside your household; (d) use the Service for any unlawful purpose.

7. Intellectual Property

  1. All content on the Service — including the audio, video, notes, mind-maps, chat responses, certificates, website design, logo, and underlying software — is the intellectual property of E-Vidya Academy (or its licensors) and is protected under the Copyright Act, 1957 and other applicable intellectual property laws. Nothing in these Terms transfers any such intellectual property to you.
  2. The syllabus and topic list referenced by our content is set independently by the relevant education authorities; our narration, wording, examples, and structure are, however, our own original work, prepared independently by our content team.

8. Accuracy of Content

Our content is generated with the assistance of artificial-intelligence tools and is reviewed on a reasonable-efforts basis, but AI-assisted content can occasionally contain errors, omissions, or inaccuracies. Treat the Service as a supplementary aid and verify important information against the student's official textbook and teacher.

9. Third-Party Services

The Service uses third-party infrastructure, including Google Firebase (for data storage) and UPI payment applications (for collecting fees). Your use of those third-party services is also subject to their own respective terms and privacy policies, over which we have no control.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including as to merchantability, fitness for a particular purpose, non-infringement, uninterrupted access, or that the Service will be error-free.

11. Limitation of Liability

  1. To the maximum extent permitted by applicable law, E-Vidya Academy's total aggregate liability to you for any and all claims arising out of or relating to the Service or these Terms shall not exceed the total subscription fees actually paid by you in the three (3) months immediately preceding the event giving rise to the claim.
  2. We shall not be liable for any indirect, incidental, consequential, special, or exemplary damages, including loss of examination performance or loss of time, arising from use of the Service. Nothing in these Terms limits liability that cannot be excluded under Indian law, including liability for fraud or wilful misconduct.

12. Indemnity

You agree to indemnify and hold harmless E-Vidya Academy, Kumudini Rout, and our staff/associates from and against any claims, losses, liabilities, and reasonable expenses (including legal fees) arising from: (a) your breach of these Terms; (b) misuse of your roll number/account; (c) any information you provide that is false or that you were not authorised to provide (including registering a student without proper parental/guardian authority).

13. Force Majeure

We shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including internet/network outages, power failure, government action, natural disaster, or failure of third-party service providers.

14. Termination

We may suspend or terminate your access to the Service for breach of these Terms, fraud, non-payment, or misuse. You may stop using the Service at any time by simply not renewing your monthly subscription; see Section 5 above for the effect on fees already paid.

15. Grievance Redressal & Governing Law

Any grievance regarding the Service should first be raised with our Grievance Officer (see our Grievance Redressal Policy). These Terms are governed by the laws of India. Subject to Section 16 below, the courts at Bhadrak, Odisha shall have exclusive jurisdiction over any dispute.

16. Dispute Resolution

Any dispute arising out of or relating to these Terms that cannot be resolved amicably within 30 days of written notice by either party shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by E-Vidya Academy, with the seat and venue of arbitration at Bhadrak, Odisha. This clause does not prevent either party from seeking urgent interim relief from a competent court.

17. Changes to these Terms

We may update these Terms from time to time. The updated Terms will be posted here with a revised "Last Updated" date, and continued use of the Service after such changes constitutes acceptance.

18. General

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect. These Terms, together with the Privacy Policy, Disclaimer, and the Refund & Cancellation Policy in Section 5 above, constitute the entire agreement between you and E-Vidya Academy regarding the Service.
